Introduction
Cosmetology Recruiter, based in Florida, USA, owns and operates a professional recruitment platform (the “Platform”) hosted at www.cosmetologyrecruiter.com (the “Website”). The Platform allows licensed beauty industry employers and recruiters to subscribe for access to our job board and candidate database, where they can post job listings, view and contact job seekers (“Candidates”), and manage recruiting processes (“Services”).
By subscribing to our Services for a specific term and at a set subscription fee (“Subscription”), you agree to the terms outlined here (“Terms”), which govern your use of the Website and Services during your Subscription period.
Nature of Our Services
Cosmetology Recruiter acts solely as a digital platform connecting employers and candidates in the beauty and cosmetology industries. We are not involved in your communication, vetting, hiring, or contractual arrangements with Candidates.
We do not supervise, employ, or control Candidates. By using our Services, you agree that:
- We are not responsible for verifying or guaranteeing the accuracy, qualifications, or availability of any Candidate.
- We do not participate in or influence any hiring or employment agreements between you and Candidates.
- Your use of the Platform does not create any employment, agency, or partnership relationship between Cosmetology Recruiter and you or your company.
Any specific features, pricing, or terms listed on the Website form part of these Terms and are binding.
Account Registration and Security
Only registered users may access the Platform and its Services.
To register, you must create an account with a unique username and password and provide accurate business and contact details. Your account may be subject to verification. If verification fails or is not completed, access to Services may be denied.
By registering, you agree that:
- Your account credentials are for your exclusive use and must be kept confidential.
- You are responsible for all actions taken using your login, even if unauthorized.
- You will promptly notify Cosmetology Recruiter of any suspected unauthorized use of your account.
Subscriptions and Access
You may subscribe to a plan via the Website. Subscriptions begin on the date of activation (“Effective Date”). You may upgrade, downgrade, or renew your Subscription via your account dashboard, with changes applying at the end of your current billing cycle.
Cosmetology Recruiter reserves the right to modify, suspend, or discontinue any Service at its sole discretion. If material changes occur, you will be notified, and you may cancel your Subscription before the change takes effect.
Fees and Payments
In consideration for your use of our Services, you agree to pay the Subscription Fees listed on the Website or in a formal agreement.
- Payment Method: Subscription Fees must be paid via credit card, debit card, or another approved method through our secure payment gateway. All transactions are encrypted for your protection.
- Authorization: You authorize Cosmetology Recruiter to charge your selected payment method for the full amount of the Subscription Fee.
- Verification: We may require additional information to verify transactions. If verification is not successful, your Subscription may be delayed or canceled.
- Taxes: Subscription Fees may include applicable U.S. federal or state taxes unless otherwise stated. Tax rates are based on your billing address at checkout.
Cancellations and Refunds
You may cancel your Subscription at any time through your account. Cancellations will apply at the end of your current term. No refunds will be issued for amounts already charged. Outstanding fees will remain payable.
Invoicing
Invoices are automatically generated upon Subscription or renewal. You can access your billing history via your account.
Free Access and Trials
We may offer free or basic access plans. Cosmetology Recruiter reserves the right to modify, limit, or terminate such access without prior notice and at its sole discretion.
Subscription Fee Changes
We may update our pricing periodically. Any change will apply to new Subscriptions or renewals and will not affect your current term. Pricing changes will be communicated in advance.
Commencement and Duration
These Terms take effect on the Effective Date and remain valid for the duration of your applicable Subscription Term.
Cosmetology Recruiter will begin providing services on the Effective Date and will continue for the duration of your Subscription Term.
Termination
Term. These Terms remain in force until: a) If you are a paid subscriber, the end of your Subscription Term or cancellation of your Subscription; or b) If you are a free user, when your account is terminated or deleted.
Cosmetology Recruiter may immediately terminate these Terms and your Subscription if:
- You breach these Terms or any restrictions outlined herein;
- Payment of Subscription Fees is overdue by more than 30 days;
- You initiate or are subject to bankruptcy, liquidation, or similar proceedings;
- You attempt arrangements with creditors or propose insolvency-related solutions;
- A resolution is passed for your voluntary dissolution;
- Your assets are subject to legal seizure;
- You default on financial obligations or are deemed insolvent under applicable U.S. laws.
Effect of Termination. If Cosmetology Recruiter terminates your Subscription for cause (due to its own fault), you’ll receive a prorated refund for the remaining prepaid period. If your Subscription is terminated due to your violation of the Terms, no refund will be provided and any outstanding fees must be paid in full.
Upon termination or expiration, you must stop using the Services. Access to the database and your uploaded data will be revoked and may be deleted unless otherwise required by law. All confidential materials in your possession must be permanently deleted or destroyed.
Termination does not affect any rights or obligations (such as payment or indemnity) that arose before the termination date.
Exclusivity These Terms are non-exclusive. You may use other service providers, and Cosmetology Recruiter may serve other clients.
Client Obligations and Restrictions To use our Services, you must:
- Be at least 18 years old;
- Complete the registration process accurately;
- Provide current and valid information;
- Agree to and comply with these Terms.
By using our Services, you agree that:
- You are responsible for the content and activity on your account;
- You will comply with all U.S. laws and regulations;
- You will not misuse the Services to infringe rights or share offensive or illegal content, as determined by Cosmetology Recruiter.
Anti-Discrimination We do not tolerate discrimination based on race, gender, religion, age, disability, sexual orientation, or national origin. Use of the Service in any discriminatory, violent, or hateful manner is prohibited.
Service Use Restrictions You may not:
- Rent, sublicense, or resell access to the Service;
- Copy, modify, reverse-engineer, or create derivative works from the platform;
- Access the Service to benchmark or develop competing products;
- Transmit malware or harmful code;
- Circumvent security or location-based restrictions;
- Use the Service for unsolicited communications or spamming.
Job Posting Restrictions If you use our Jobs Service, you agree not to:
- Post fake, misleading, or deceptive job listings;
- Fail to clearly identify contract, part-time, or commission-based roles;
- Solicit fees from applicants;
- Share candidate data with external third parties;
- Harass or contact applicants against their wishes;
- Violate U.S. employment or anti-discrimination laws;
- Engage in illegal recruitment tactics or spam job seekers.
Cosmetology Recruiter reserves the right to remove any job listing or suspend access to the Jobs Service at any time for any reason.
Failure to comply with these obligations may result in immediate termination of your Subscription.
Intellectual Property Cosmetology Recruiter retains full ownership of all intellectual property created in connection with the Services. This includes databases, content, systems, methods, software, and improvements. All such property remains the sole property of Cosmetology Recruiter.
You irrevocably assign any rights you may have in such intellectual property to Cosmetology Recruiter.
Your License to Cosmetology Recruiter You retain ownership of all content submitted to the platform. By submitting content, you grant Cosmetology Recruiter a worldwide, transferable license to use, process, publish, and distribute your content for the purpose of providing the Services.
You may terminate this license by deleting your content or account, except:
- When your content has been shared or copied by others;
- While it remains in backup systems for a reasonable time.
We may reformat, transcribe, or translate your content without changing its meaning.
Warranties and Disclaimer Cosmetology Recruiter does not guarantee uninterrupted or error-free Service, nor does it promise specific results from Service use. The Services are provided “as-is” and “as-available.”
You are solely responsible for how you use the Services and for any consequences resulting from such use.
Each party represents that:
- It has the authority to enter into these Terms;
- The execution of these Terms will not breach any existing contracts;
- These Terms are legally binding and enforceable.
Other than the warranties listed above, Cosmetology Recruiter provides no additional warranties of any kind.
